Avoid These Common Divorce Mistakes

The tabloids are filled with stories of possible celebrity divorce, fueling rumors about which celebrity couple will soon be calling it quits. While celebrity and divorce do seem to go hand in hand, divorce is just as common in non-celebrity relationships. Regardless of notoriety, the causes of divorce and the mistakes people make during the divorce process are typically the same.

One of the most common mistakes that people make when going through a divorce is their inability to take the high road, especially when it comes to insignificant issues. Instead of focusing on the bigger picture, many people become petty and fight for no other reason but to fight. A smart litigant avoids unnecessary conflict and will concede on smaller issues in order to prevail on those which actually matter.

Another common mistake made during the divorce process is when a party speaks before thinking, saying horrible things to, or about, their spouse which could ultimately come back to haunt them if the case were to proceed to Trial.

A long separation period before actually filing for and ultimately getting divorced routinely makes things worse as, by living apart for a significant period of time, couples tend to grow further apart and the settlement process is often made more combative. Again, allowing one’s emotions to rule instead of using sound judgment is never a good idea.

Further, many people enter the divorce process with highly unrealistic expectations about custody and property division, and believe that because “a friend” received a certain settlement in their divorce that they will be entitled to the same outcome. Each divorce settlement is unique and is based upon the couple’s finances, schedules and, most importantly, their willingness to work together and compromise.

Divorce is a difficult process to go through, but many couples make it worse than it has to be as a result of poor decision making and a need to be “right”. No one is perfect and people make mistakes, but many of these mistakes are avoidable.
